§ 1 Toepassingsgebied

Deze Algemene Voorwaarden betreffen de contractuele relatie tussen jou als person en wij, IC Music And Apparel GmbH en zijn geldig voor zakelijke relatie met consumenten zoals beschreven is in artikel §13 van de Civil Code. De consument is volgens deze regulatie elk natuurlijk persoon die een legale deal sluit voor een aankoop, waaronder commerciële noch een onafhankelijke professionele activiteit kunnen vallen. De Algemene Voorwaarden zijn geldig voor de aangeboden producten op het domein www.impericon.com en onze geprinte catalogus. We complementeren je order gebaseerd op deze Algemene Voorwaarden zodra je bestelling is geplaatst. Onze Algemene Voorwaarden zijn beschikbaar in de door ons verstuurde geprinte catalogi en onze internet website ww.impericon.com.

§ 2 Sluiting van de overeenkomst

Bestellen bij ons kan op internet via onze homepage www.impericon.com. De presentatie van producten in onze webshop en in de catalogus kan afwijken van het daadwerkelijke product. In het winkelmandje heb je de mogelijkheid om de bestelling te voltooien door op de knop “Verder naar afrekenen” te klikken. Na het invullen van je persoonlijke data vind je een overzicht van je bestelling bij de laatste stap van het bestelproces. Hier kun je de bestelling nog eens bekijken en heb je de kans om indien nodig dingen te wijzigen. Na het klikken op de knop “Bestelling Bevestigen” bevestig je het bod op de gekozen items. Wij zijn geautoriseerd om je aanbieding te accepteren binnen 14 dagen door hier een bevestiging van te sturen (via mail of post). De bestelling is niet geaccepteerd totdat we dit hebben bevestigd. Mochten we binnen 14 dagen niet reageren dan is het bod afgewezen. Producten die niet zijn genoemd in de bevestiging zijn geen onderdeel van de verkoop.

§ 3 Levering

Producten die op voorraad zijn leveren we binnen 5 werkdagen via GLS/DHL af bij het door jou opgegeven adres. Levering buiten de Federale Republiek van Duitsland en binnen Europa kan de levering, als de producten op voorraad zijn, ongeveer 10 tot 14 werkdagen duren. De tijd van levering buiten Europa hangt af van de manier van verzenden en het land waarin het geleverd moet worden. Alle levertijden of leverperioden zijn niet bindend, maar gebaseerd op een overeenkomt. De voorgaande informatie over toekomstige data van levering of tijdschalen zijn niet bindend, tenzij uitdrukkelijk overeengekomen tussen de consument en ons. In het geval van een uitdrukkelijk overeengekomen datum van levering moet je ons bij vertraging de tijd gunnen dat we tot 2 weken extra de tijd krijgen. Indien we binnen die tijdschaal niet kunnen leveren krijg je het recht om de koop te ontbinden. Mocht een artikel niet op voorraad zijn binnen de aangegeven tijdschaal dan laten wie zo snel mogelijk voor de afleverdatum weten, of hoor je van ons dat de levering niet plaats kan vinden.

§ 4 Retourinstructie

Retourrecht

Het is mogelijk om elk ontvangen item zonder opgave van reden terug te sturen binnen 30 dagen. De periode voor het retourneren begint zodra u de bestelling heeft ontvangen, in geval van meerdere pakketten geldt de ontvangst van het eerste artikel en niet na het lezen van de instructies zoals in overstemming is met sec. 246 subs. 2 juncto sec. 1 subs. 1, 2 wetsontwerp en in overeenstemming met sec. 312 g, subs. 1 zin 1 BGB in combinatie met sec. 246 subs. 3 EGBGB. Om deze deadline te garanderen moet u zorgen dat de goederen binnen deze periode bij ons aankomen. Het retourneren is altijd op onze kosten en ons risico.

De volgende producten zijn uitgesloten van retourrecht:

  1. Goederen die na de verkoop zijn gefabriceerd naar wensen van de consument or zijn aangepast naar speciale wensen kunnen niet retour gezonden worden vanwege hun voorkomen en vakmanschap.
  2. CD´s, DVD´s of Software in ongesealde conditie.
  3. Tickets en ticketbundels ( bijvoorbeeld. t-shirt en ticket)
  4. Piercings (plugs, tunnels), voor zover ze uitgepakt zijn.

Retour consequenties

Zodra we het teruggestuurde item hebben ontvangen controleren we deze om er zeker van te zijn dat deze niet is beschadigd of dat er anderzijds sprake is van een gebrek waardoor we het item niet meer kunnen verkopen. In het geval van schade die dermate erg is dat het niet is ontstaan door het bekijken of passen van het product, zoals normaal gezien ook in een winkel zou gebeuren, kan er een financiële vergoeding worden geëist. Je kunt de schade dus beperken door het item niet te gebruiken alsof het van jou is maar door het te bekijken zoals je dat in een winkel doet. Het is tot 30 dagen na aankoop mogelijk om het item om te ruilen zonder opgave van reden. Deze periode begint voor de koper bij het retourneren van het item of het versturen van een retourverzoek en bij IC Music & Apparel na het ontvangen van het item. Als een gratis item bij het afrekenen aan een order wordt toegevoegd, dan dient dit item bij eventueel retourneren ongebruikt zijn. Als dit niet het geval is dan zal de verkoopprijs van het corresponderende gratis item in rekening worden gebracht.

Gebruik voor het terugsturen het inpakmateriaal dat je van ons hebt gekregen of pak de items zorgvuldig in zodat ze in goede staat bij ons terug komen.
