§ 1 Préambule

Les présentes conditions générales de vente s'appliquent de façon exclusive entre la IC Music and Apparel GmbH, Deutscher Platz 4, 04103 Leipzig, Allemagne (ci-après « Nous ») et toute personne visitant ou effectuant un achat via le site www.impericon.com Tout internaute peut prendre connaissance des Conditions générales de vente sur le site www.impericon.com. Elles ne sont valables que pour les commandes passées pour la France. Ces Conditions générales de vente pouvant faire l'objet de modifications, les conditions applicables sont celles en vigueur sur le Site à la date de passation de votre commande.

Si, en dépit de notre vigilance, les articles sont indisponibles, Nous Vous en informerons par e-mail dans les meilleurs délais.
(i) En cas d'indisponibilité dans les délais indiqués, Nous Nous réservons la possibilité de Vous proposer en remplacement un article d'une qualité et d'un prix équivalent. Dans ce cas, les frais de retours consécutifs à l'exercice éventuel du droit de rétractation seront à notre charge. (ii) En cas d'indisponibilité permanente, et si Nous ne pouvons pas Vous fournir un article de qualité et de prix équivalent, Votre commande sera annulée automatiquement. Nous vous rappelons que votre carte de paiement n'est débitée qu'au moment de l'expédition de votre commande. Par conséquent, dans le cas où un article ne serait pas disponible et aucun article de remplacement ne pourrait Vous être livré, votre carte de paiement ne sera pas débitée. Malgré tous nos efforts, il se peut qu'un nombre restreint parmi les millions d'articles figurant sur Notre Site comporte une erreur de prix. Soyez assurés cependant que Nous procédons à la vérification des prix lors de la procédure d'envoi de votre article. Si le prix corrigé est inférieur au prix affiché sur le Site, Nous Vous appliquerons le prix le plus bas et Vous adresserons Votre article. Toute commande passée sur le Site et livrée en dehors de la France pourra être soumise à des taxes éventuelles et à des droits de douane qui sont imposés lorsque le colis parvient à sa destination. Ces droits de douane et ces taxes éventuels liés à la livraison d'un article sont à votre charge et relèvent de votre responsabilité. Nous ne sommes pas tenus de vérifier et de Vous informer des droits de douane et taxes applicables. Nous vous envoyons confirmation de votre commande par email. Après réception du paiement par notre banque, vos produits vous sont expédies.

d) Carte de Crédit

Nous acceptons les VISA, Mastercard et Maestro. Le paiement est sécurisé et vos informations sont rapidement traités, sans complications. En cas de règlement par carte de paiement, le montant de votre commande n'est débité qu'au moment de l'expédition de vos articles.

e) Amazon Pay

§ 6 Retours

Droit de Retour

Vous pouvez nous retourner tout article reçu sans donner de raison sous 30 jours en nous renvoyant les articles. La période de retour commence au moment ou vous recevez les informations de droit de retour, mais pas avant que vous ayez reçu les marchandises (en cas de livraison en plusieurs colis, cela s'applique à la date de réception du premier article) et pas avant d'avoir vu avec notre service clientèle en accord avec la sec. 246, subs. 2 en conjonction avec sec. 1 subs. 1, 2 EGBGB et en accord avec sec. 312 g, subs. 1, clause 1 BGB en conjonction avec sec. 246 subs. 3 EGBGB. Afin d'assurer la deadline, merci de renvoyer les articles dans cette période. Le retour sera de toute façon à notre coût et à notre risque.

Les biens suivants sont exclus du droit de retour:

  • 1. des biens qui ont été fabriqués après la vente aux spécifications du client, ne peuvent pas être retourné pour cause de leur apparence et la main d’œuvre.
  • 2. CDs, DVDs ou logiciels qui ont été ouvert
  • 3. Billets et packs billets (billet + Tshirt)
  • 4. Piercings (plugs, tunnel), tant qu’ils n’ont pas été ouvert

Conséquences de retour

En cas d'un retour complet, la totalité des biens reçus, si il y a, des exploitations conséquentes doivent être rendues aux deux partis. En cas de défaut des biens et des exploitations (ex:avantages d'utilisation), à tel point qu'il ne puisse pas en partie, ou pire, être rendu, vous devrez payer la compensation. Vous devrez payer la compensation des défauts des biens ou de l'exploitation reçue uniquement si le défaut du bien ou de l'exploitation reçue peuvent être liés à votre usage. Sous "vérification des Biens et de leur fonctionnement" il faut comprendre les méthodes de vérification identiques à celles d'un magasin physique. Le remboursement doit être payé sous les 30 jours. La deadline commence avec l'envoi du colis, ou la demande de retour par vous, et commence à la réception des biens par nos soins. Si un article offert est ajouté à votre commande, en cas de retour, celui-ci ne doit pas avoir été utilisé. Si ce n'est pas le cas, la valeur de l'article offert vous sera réclamée.

§ 7 Réserve de propriété

Les biens livrés demeurerent notre propriété jusqu'à leur expédition lors de la remise au transporteur, une fois que Vous en avez acquitté le prix.

§12. Integration of Google Adwords Conversion

(1) We use the offer of Google Adwords, in order to draw attention to our attractive offers with the help of means of advertisement (so-called Google Adwords) on external web pages. In relation to the data of the advertising campaigns, we can determine how successful the individual advertising measures are. We are interested in showing you advertisements that are of interest to you, to make our website more interesting to you and to achieve a fair calculation of advertising costs.

(2) These advertising materials are supplied by Google via so-called "ad servers". To do this, we use ad server cookies, which measure certain performance metrics such as ads or user clicks. We have no control over the extent and the further use of the data, which are raised by the employment of this tool by Google and inform you therefore according to our knowledge level: By the incorporation of AdWords conversion Google receives the information that you the appropriate part of our Internet appearance or clicked on an ad from us. If you are registered with a service provided by Google, Google may assign the visit to your account. Even if you are not registered with Google or have not logged in, there is a chance that the provider will find and store your IP address.

(5) You can prevent participation in this tracking process in several ways:
(a) by setting your browser software accordingly, in particular, the suppression of third party cookies will prevent you from receiving any third party advertisements;
